German compliance is complex

Let us handle the challenges so you can focus on your business.

Works Council Requirements

Companies with 5+ employees may need to establish a works council. Non-compliance can invalidate employment decisions.

Virmondo EOR guides you through works council requirements and handles all communication compliantly.

Strict Termination Protection

After 6 months, employees have strong dismissal protection. Improper termination can result in costly wrongful dismissal claims.

We manage compliant offboarding procedures and documentation to protect both parties.

Contractor Misclassification

Fines up to EUR 500,000 and personal liability for executives. German authorities actively audit misclassification.

Our EOR model ensures proper employment status from day one. No risk of misclassification.

Complex Social Security

Employers must contribute ~21% to pension, health, unemployment, and nursing care insurance. Errors trigger penalties.

We handle all social security registration, contributions, and reporting automatically.

Important: 18-Month Limit

The 18-month rule: What you need to know

Under German labor leasing law (AUG), employees hired through an EOR can only work for the same client company for up to 18 months. This is a legal requirement, not a Virmondo EOR policy.

1

3-month break

After 18 months, the employee takes a 3-month break from the client assignment. They can then be re-engaged for another 18-month period.

2

Entity setup

Virmondo EOR can assist with setting up a German GmbH to directly employ your team. We offer transition support to make this seamless.

3

Foreign employer registration

Register your existing foreign company as an employer in Germany. This allows direct employment without a German entity.

4

Role change

If the employee moves to a different role or department, the 18-month clock may reset. We advise on compliant approaches.

Virmondo EOR handles this for you

Virmondo EOR proactively tracks your 18-month timelines and initiates transition planning 6 months before the limit. You'll never be surprised.

Frequently asked questions

Everything you need to know about hiring in Germany.

No. With Virmondo EOR, we become the legal employer in Germany on your behalf. You maintain full day-to-day management of your employee while we handle all legal employment, payroll, and compliance requirements. This saves you the EUR 25,000+ and 6-12 weeks typically required for entity setup.
Typically 3-5 business days from providing candidate details to having a signed contract. This compares to 6-12 weeks for entity setup. We can expedite to 48 hours for urgent hires.
Our EOR service costs €599 per employee per month. This includes employment contracts, payroll processing, tax compliance, benefits administration, and ongoing HR support. There are no hidden fees, setup costs, or minimum commitments.
German law requires: minimum 20 vacation days (most employers offer 25-30), statutory health insurance, pension contributions (~18.6% split equally), unemployment insurance, long-term care insurance, and 6 weeks of full sick pay. Virmondo EOR manages all statutory requirements and can arrange supplementary benefits.
As of January 2026, the minimum wage is EUR 13.50 per hour. This will increase to EUR 14.20 in October 2026. Virmondo EOR ensures all employment contracts meet current minimum wage requirements.
Germany has strong employee protection laws. During the 6-month probation period, either party can terminate with 2 weeks notice. After probation, notice periods range from 4 weeks to 7 months depending on tenure. After 6 months, employers generally need a valid reason to terminate. Virmondo EOR guides you through compliant termination procedures.
The AUG (Arbeitnehmeruberlassungsgesetz) license is required for all EOR providers in Germany. Under this law, employees can only work for the same client via an EOR for 18 months maximum. Virmondo EOR holds a valid AUG license and proactively plans transitions before the 18-month limit.
At 18 months, we help you transition to one of several options: a 3-month break before re-engagement, setting up a German entity, registering as a foreign employer, or restructuring the role. Virmondo EOR initiates transition planning 6 months early so you're never caught off guard.
Germany actively enforces contractor classification rules. Misclassification can result in fines up to EUR 500,000, back-payment of social contributions, and personal liability for executives. Using Virmondo EOR eliminates this risk entirely as we properly employ your workers from day one.
A works council (Betriebsrat) is an employee representative body. If you have 5+ permanent employees in Germany and they request it, you must allow formation. Works councils have co-determination rights on hiring, working hours, and terminations. Virmondo EOR helps you navigate works council requirements compliantly.
Both. Unlike most EOR providers, Virmondo EOR offers recruiting services for DACH talent at a one-time fee of €1,000. We can source, vet, and hire candidates for you, then employ them through our EOR service. This bundled approach is unique in the market.
On top of gross salary, expect ~20-22% in employer contributions: pension (9.3%), health insurance (7.3%), unemployment (1.3%), long-term care (~1.7%), and accident insurance. Plus our €599/month EOR fee. We provide detailed cost breakdowns before you hire.
